SEARCHES: if not included as part of the HIP these are conducted by the buyer’s solicitor who submits a local authority search to the local borough council. Its purpose is to ascertain if there are any planning consents/building regulations previously granted on the property or if there are any other local issues which may have an impact on the purchase. Other searches that can be applied for include an Environmental/Drainage or Chancel search. There are other searches that can be undertaken but your solicitor will advise if they are deemed necessary.

DRAFT CONTRACTS: The draft contract is drawn up by the seller’s solicitor and two copies are forwarded to the buyer’s solicitor for consideration, who may raise queries or questions as a result. Once their queries have been satisfied and the contract amended accordingly, then the buyer's solicitor retains one copy for the buyer to sign and returns the other approved copy to the seller's solicitor for the seller to sign.

MORTGAGE OFFER:  When the Lender is in possession of the Mortgage Valuation survey and, subject to the findings of this report; and they have approved the mortgage application (providing their references and checks have been conducted satisfactorily), the Lender will send a formal mortgage offer to the buyer and their solicitor. The lender will require the solicitor to report to them on the property and arrange for the buyer to sign the mortgage deed. They can then request that the mortgage funds are made available for completion day.

EXCHANGE OF CONTRACTS: Once the contracts have been signed by both parties, a deposit (normally a small percentage of the purchase price) is paid by the buyer to their solicitor, by either bank transfer or banker’s draft. At this stage, the parties agree on a date for completion and the contracts becomes legally binding for both parties.

COMPLETION: Completion usually follows a few days or weeks after exchange of contracts. The balance of the purchase price is transferred by the buyer’s solicitor to the seller’s solicitor and the keys released – Congratulations! You are now the owner of your new home!
